Terms of Service

These terms govern access to and use of SMM Control.

1. Acceptance

By creating an account, signing in after accepting the legal checkbox, starting a trial, purchasing a plan, connecting a social account, or using the service, you agree to these Terms, the Privacy Policy, and the Data Deletion instructions. We may record the date, time, account, IP-derived technical data, and document version associated with acceptance.

2. Service

SMM Control helps users prepare social media content: brand context, content plans, captions, carousel slides, editable visuals, approval workflows, scheduling, and publication through supported official APIs. The current production scope is a single-workspace Meta/Threads/LinkedIn text flow unless a separate written agreement says otherwise.

The service may support, plan for, export to, or later integrate with Instagram, Facebook, Threads, LinkedIn, Pinterest, TikTok, YouTube Shorts, X/Twitter, Reddit, Telegram, and other social or content platforms. Availability depends on the selected plan, platform API access, region, account permissions, app review, technical status, and our current implementation.

A platform appearing in the interface, calendar, or destination list does not guarantee automatic publishing. Some channels may be planning-only, export-only, or manual-publishing channels until an official integration is active.

3. Eligibility

The service is intended for business and professional use. You must be legally able to enter into these terms and, if you use the service for an organization, authorized to bind that organization and manage its connected social accounts.

4. Account responsibility

  • You must provide accurate account information and keep access to your Google and connected social accounts secure.
  • You are responsible for all activity under your account and for deciding who may access your workspace.
  • You must have authority to connect Instagram, Facebook, Threads, LinkedIn, Pinterest, TikTok, YouTube, X/Twitter, Reddit, Telegram, or any other social profile used with the service.

5. Content and approvals

AI-generated topics, captions, slides, visuals, and schedules are drafts. You are responsible for reviewing, editing, approving, and legally clearing all content before publication. The service must not be used to publish unlawful, misleading, infringing, discriminatory, harassing, unsafe, or platform-prohibited content.

You keep ownership of content you submit. You grant DO.Marketing OÜ a limited right to host, process, transform, export, and transmit that content solely to provide and secure the service.

The service is a preparation, workflow, and technical transmission tool. We are not the publisher, editor, legal reviewer, advertising reviewer, or rights-clearance provider for user-approved content. Clicking a publish, schedule, approve, connect, or export action is your instruction to process or transmit the selected content.

6. AI limitations

  • AI output may be incomplete, inaccurate, outdated, or unsuitable for your use case.
  • You must verify factual, legal, medical, financial, advertising, and platform-compliance claims before use.
  • You must not submit sensitive personal data, trade secrets, passwords, payment data, or third-party confidential data unless you have the right and lawful basis to do so.

7. Social platform integrations

Publishing depends on third-party APIs and permissions controlled by Meta, Instagram, Facebook, Threads, LinkedIn, Pinterest, TikTok, YouTube, X/Twitter, Reddit, Telegram, Google, Supabase, and other providers. We do not control their availability, review decisions, rate limits, policy changes, takedowns, account restrictions, or API errors. You must comply with each platform's terms, community standards, advertising rules, and developer policies.

Users do not receive direct access to OAuth tokens, platform tokens, encryption keys, or app credentials. Tokens are technical integration credentials stored and used under the hood to connect accounts, check status, publish or schedule approved content, cancel scheduled jobs, refresh integration state, and disconnect accounts. We do not provide token export because exposing tokens can create unauthorized access risk.

8. Prohibited use

  • No attempts to bypass authentication, authorization, rate limits, security controls, or platform approval gates.
  • No scraping, credential sharing, malware, spam, phishing, deceptive impersonation, or unlawful profiling.
  • No uploading content that violates privacy, intellectual property, publicity, consumer protection, advertising, or data protection laws.
  • No use that targets children or processes special-category personal data unless a written agreement explicitly allows it.

9. Availability and changes

The service is provided on a commercially reasonable basis. Features may change to improve security, reliability, legal compliance, or platform compatibility. Scheduled publishing is available only when the production cron, Supabase queue, public media URLs, and connected social accounts are correctly configured.

10. Plans, trials, fees, and cancellation

The service may offer free trials, paid subscriptions, and other plans. Specific prices, billing periods, plan limits, and included features are shown before purchase or in the applicable order form, invoice, checkout page, or written agreement.

  • Plans may differ by AI generation limits, publications, scheduled posts, connected destinations, users, workspaces, storage, analytics, support, and other features.
  • If a limit is reached, the relevant feature may be blocked until the next billing period or until you upgrade.
  • Subscriptions renew automatically for each billing period unless canceled before the renewal date.
  • Canceling stops future renewals. Unless required by law or expressly agreed otherwise, already paid fees are not refunded.
  • After cancellation, paid features remain available until the end of the paid period and may then be limited or blocked.
  • A trial is available only once per user/email/account. We may use email, payment data, company domain, connected accounts, technical identifiers, and other reasonable signals to prevent repeated trial abuse.
  • When a trial ends without payment, paid features may be blocked.

11. Email and product communications

We may send service emails about account access, security, billing, legal updates, integrations, publish failures, and core product operation. Marketing emails about features, offers, education, or news are sent only where we have consent or another lawful basis. You can withdraw marketing consent using the unsubscribe link or by contacting us.

12. Data protection roles

For account, billing, security, support, legal compliance, and service operation data, DO.Marketing OÜis generally an independent controller. For company content, audience notes, brand materials, customer-provided workspace data, connected social account data, and publication instructions processed on behalf of a business customer, we may act as a processor under that customer's instructions. Additional data processing terms may apply for business customers.

13. Liability

To the maximum extent permitted by law, the service is provided without warranties that it will be error-free, uninterrupted, or fit for every campaign. We are not liable for indirect damages, lost profits, lost social reach, platform penalties, rejected posts, or consequences of content approved by the user. Nothing in these terms limits liability where it cannot be limited under applicable law.

14. Governing law and contact

These terms are governed by the laws of Estonia, unless mandatory consumer protection rules say otherwise. Contact: privacy@smm.domarketing.ee.
